I concur w/David- he doesn't owe you the money back. He may have done a shitty job and gave bad advice, but he taught you a lesson. Caveat Emptor.
I wouldn't sweat the mileage. I get low 40s in town (around 8 miles each way to work), but get around 50-55 on the highway. I've monkeyed around a bit with it though (pipe, carb mods, hotter Split-Fire plug, etc...)
